Welcome to Cymatic. These Terms of Service (“Terms”) govern your access to and use of the Cymatic mobile application, website, content, features, and related services (collectively, the “Service”).

Please read these Terms carefully. By creating an account, downloading the app, accessing the Service, or using Cymatic, you agree to these Terms. If you do not agree, please do not use the Service.


1. Who We Are

Cymatic is a sound and meditation app designed to help users create personal wellness sessions using frequencies, ambient sound, music, guided meditations, breathwork, and related features.

The Service is operated by Tiffany Stewart (“Cymatic,” “we,” “us,” or “our”).

2. Eligibility

You must be at least 13 years old to use Cymatic. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.

By using Cymatic, you confirm that you are legally able to agree to these Terms.


3. Wellness Disclaimer

Cymatic is intended for general wellness, meditation, relaxation, focus, breathwork, and personal self-care. Cymatic is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease, condition, or mental or physical health issue.

The content and experiences provided through Cymatic are for informational and wellness purposes only. They are not a substitute for medical advice, therapy, diagnosis, or treatment from a qualified healthcare professional.

If you have a medical condition, mental health concern, hearing sensitivity, epilepsy, vestibular sensitivity, respiratory condition, are pregnant, or have any concern about whether sound, meditation, or breathwork is appropriate for you, consult a qualified healthcare professional before using the Service.

If you experience discomfort, dizziness, anxiety, shortness of breath, pain, distress, or any other adverse reaction while using Cymatic, stop using the Service immediately.


4. Safety While Using Cymatic

Do not use Cymatic in situations where reduced attention, relaxation, closed eyes, breathing exercises, or audio immersion could create risk, including while driving, cycling, operating machinery, walking in unsafe environments, or performing tasks that require full attention.

You are responsible for using Cymatic safely and appropriately for your own circumstances.


5. Accounts

Some features may require you to create an account. You agree to provide accurate information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been accessed without permission, contact us promptly.

We may suspend or terminate your account if we believe you have violated these Terms, created risk for Cymatic or other users, or used the Service in a way that is unlawful, harmful, or abusive.


6. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect information. Please review the Privacy Policy before using Cymatic.

7. Subscriptions, Trials, and Payments

Cymatic may offer free features, paid subscriptions, free trials, or premium features in the future.

If paid features are offered through the Apple App Store, Google Play Store, or another app marketplace, billing, renewal, cancellation, and refunds may be handled by that marketplace according to its terms and policies.

Unless otherwise stated, subscriptions automatically renew until canceled. You are responsible for managing and canceling your subscription through the platform where you purchased it.

We may change pricing, features, or subscription plans from time to time. Any changes will apply according to applicable law and platform rules.


8. Your Use of the Service

You agree not to misuse the Service. You may not:

  • Use the Service for unlawful, harmful, abusive, or fraudulent purposes.

  • Interfere with, disrupt, reverse engineer, or attempt to gain unauthorized access to the Service.

  • Copy, reproduce, distribute, sell, or exploit any part of the Service without permission.

  • Use automated systems, bots, scraping, or similar methods to access the Service without authorization.

  • Upload or share content that infringes on another person’s rights, violates law, or is harmful, abusive, or misleading.

  • Attempt to bypass security, authentication, payment, or usage restrictions.

We may take action, including limiting, suspending, or terminating access, if we believe the Service is being misused.


9. Cymatic Content and Intellectual Property

The Service, including its design, interface, sounds, audio experiences, guided meditations, text, graphics, logos, visual systems, software, and other content, is owned by Cymatic or its licensors and is protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use.

You may not copy, modify, distribute, sell, lease, publicly perform, publicly display, or create derivative works from the Service or its content unless we give you written permission.


10. User Content and Feedback

If Cymatic allows you to submit, upload, or create content through the Service, you retain ownership of content you own. By submitting content, you grant Cymatic a limited license to use, host, store, process, display, and transmit that content as needed to operate and improve the Service.

If you provide ideas, suggestions, feedback, or recommendations about Cymatic, you agree that we may use them without restriction or compensation to you.


11. Third-Party Services

Cymatic may rely on or link to third-party services, platforms, payment processors, analytics providers, app stores, authentication providers, or other services that we do not control.

Your use of third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party services, content, policies, or practices.


12. App Store Terms

If you download Cymatic from the Apple App Store, Google Play Store, or another app marketplace, your use of the Service may also be subject to that marketplace’s terms, policies, and payment rules.

If there is a conflict between these Terms and the app marketplace terms, the app marketplace terms may apply to the extent required for your use of that platform.


13. Changes to the Service

We may update, change, suspend, or discontinue any part of the Service at any time. We may also add, remove, or modify features, content, subscriptions, availability, or functionality.

We are not liable for any modification, suspension, or discontinuation of the Service.


14. Termination

You may stop using Cymatic at any time. You may also request deletion of your account if account deletion is available in the app or by contacting us at hello@cymatic.space.

We may suspend or terminate your access to the Service if we believe you have violated these Terms, used the Service in a harmful or unlawful way, or created risk for Cymatic, other users, or third parties.

Sections that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related provisions.


15. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Cymatic disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and uninterrupted operation.

We do not guarantee that the Service will be secure, error-free, uninterrupted, compatible with every device, or free from defects. We do not guarantee any particular wellness, emotional, mental, physical, or personal result from using Cymatic.


16. Limitation of Liability

To the fullest extent permitted by law, Cymatic and its owners, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, device issues, personal injury, or other damages arising from or related to your use of or inability to use the Service.

To the fullest extent permitted by law, Cymatic’s total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to use the Service in the three months before the claim arose, or (b) $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.


17. Indemnification

You agree to defend, indemnify, and hold harmless Cymatic and its owners, employees, contractors, affiliates, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use or misuse of the Service;

  • your violation of these Terms;

  • your violation of any law or third-party right;

  • any content or information you submit through the Service.


18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the Service, by email, or by other reasonable means.

The updated Terms will be effective when posted or as otherwise stated. Your continued use of the Service after the updated Terms become effective means you accept the updated Terms.


19. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles, unless the laws where you live require otherwise.


20. Dispute Resolution

Before bringing a formal legal claim, you agree to first contact us at hello@cymatic.space and attempt to resolve the dispute informally. We will try to resolve disputes in a fair and reasonable way.

If a dispute cannot be resolved informally, the dispute will be handled in the courts located in Multnomah County, Oregon unless applicable law requires another venue.
